II. Data protection statement

We take the protection of your personal data very seriously. Therefore, we would like to inform you whether and which of your data we process when using our eBay offers. This privacy notice applies exclusively to data processing within our eBay listings.

1. Personal data

Personal data is any information relating to an identified or identifiable natural person (hereinafter referred to as data subject); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Personal data therefore includes, for example, your name, home address, gender, date of birth, age, telephone number, email address or IP address. This list is not exhaustive and is only intended to illustrate what may fall under the concept of personal data.

3. Contact

In the context of contacting us, personal data are collected, which these are, you can see from the eBay contact form. This data is stored and used exclusively for the purpose of responding to your request or for contacting you and the associated technical administration. The legal basis for the processing of the data is Art. 6 para. 1 p. 1 lit. b) DS-GVO, if it is an inquiry regarding one of our services. Should you send an inquiry that is not related to our services, we will process your personal data in accordance with Art. 6 (1) p. 1 lit. f) DS-GVO in order to process your inquiry.

If you object to us processing your personal data, we will not be able to process your request.

We store your data containing pre-contractual or general non-contractual inquiries for a period of 6 months. Emails regarding orders, complaints and invoices are stored for 12 months and in cases where there is a warranty, for the warranty period.

4. Data processing for order processing

When you place an order, we process your personal data only to the extent necessary for the fulfillment and processing of your order and to process your requests. The processing is based on Art. 6 para. 1 p. 1 lit. b) DS-GVO and is necessary for the conclusion and performance of a contract with you. Failure to provide this data will result in no contract being concluded.

The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected and provided that there are no legal retention periods to the contrary.

Your data will not be passed on to third parties without your express consent. The only exceptions to this are our service partners that we need to process the contractual relationship or service providers that we use as part of order processing. These are recipients of the following categories: Shipping service providers, payment service providers, merchandise management service providers, sales portal operators.

5. Newsletter

We use the eBay newsletter service. You will receive a regular newsletter from us, and only if you have used the function "Subscribe to seller newsletter" and have agreed to the newsletter dispatch there. eBay informs us about your consent and tells us your eBay name. We do not receive any further data from you due to this function. The data processing is therefore based on Art. 6 para. 1 p. 1 lit. a) DS-GVO with your consent.

You can revoke your consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until the revocation. If you wish to revoke consent, you can do so in your profile under "My eBay". The exact mode of operation (e.g. the depth of the menu navigation) is determined solely by eBay. You can therefore find the individual steps in the FAQ.

We would like to point out that by agreeing to receive our newsletter, you enable eBay in particular to analyze this aspect of your user behavior as well.

6. Other eBay services and features

We use various eBay services to further optimize our eBay offers and purchase processing, so that the processing takes place on the basis of Art. 6 (1) p. 1 lit. f) DS-GVO. These are the following services and functions:

- Purchase processing "after buy", in order to make the handling after the conclusion of the purchase contract more convenient and faster.

- Restricted group of buyers, in order to exclude any possibly insolvent customers from the conclusion of the contract from the outset (here, however, we do not receive any personal data from eBay; the filtering is carried out - according to our criteria - by eBay alone).

- Services and applications from eBay and third-party providers. These are functions and services, such as "eBay Business Policies Management", "eBay Marketplace", all of which ensure the proper functioning of the eBay store and the individual listings.

- "Share" link for Facebook, Twitter and Pinterest. In our eBay store, we do not receive any information about any operation of these functions by the user. We are - depending on the extent of sharing, e.g. share publicly, share for friends or share in private message - at most informed about this action on our corresponding social media profile. We do not know whether and what information is exchanged between eBay and the respective social media provider and refer in this respect to the respective privacy notices and FAQ.

8. Rights of the data subject

As a data subject, you have the following rights:

- Revocation of a data protection consent according to Art. 7 para. 3 DS-GVO

- Information according to Art. 15 DS-GVO

- Revision according to Art. 16 DS-GVO

- Deletion ("right to be forgotten") according to Art. 17 DS-GVO

- Restriction of processing according to Art. 18 DS-GVO

- Notification according to Art. 19 DS-GVO

- Data portability according to Art. 20 DS-GVO

- Objection according to Art. 21 DS-GVO

- Complaint to a supervisory authority according to Art. 77 DS-GVO.

9. Reference to the eBay data protection declaration

eBay GmbH, Albert-Einstein-Ring 2-6, 14532 Kleinmachnow in Germany (eBay) is responsible for all further data processing that goes beyond the data processing described above on the eBay platform. 10. Data security

We have established technical and organizational security measures to protect your data, in particular against loss, manipulation or unauthorized access. We regularly adapt our security measures to ongoing technical developments.

11. Regular updating of this data protection notice

The legal framework for us as a product provider is naturally subject to changes and adjustments. These changes and adjustments make it necessary to update this data protection notice from time to time. You can recognize the respective status by the second line of the heading.
